buying pellet rifle at Dicks, what is the process

I though pellet pistols were treated differently than pellet rifles?

They are if your buying one in NJ, a P2P is required. In just about every other state they are not considered a firearm and its legal to sell to anyone 18 years of age or above.

Federally, pellet guns and black powder guns are not considered firearms by the BATF. Which means you can buy them through interstate commerce.  Which means someone from NJ can buy pellet and black powder guns in PA, DE, OH or anywhere else without ID cards, purchase permits, going through an FFL or being a state resident.

 

If you buy pellet and black powder guns in NJ, you need the FID or P2P. When you buy these items in PA or in other states, the FID or P2P is not needed.

 

Firearms as defined by the BATF is different,  which means by Federal Law both the seller and buyer must be in the same state for handguns.

 

Or, a long gun through a FFL in another state and you need your FID to buy a long gun from an FFL in another state. (Assuming of course it is Jersey legal).

 

Summary:

 

Firearms are regulated by the BATF in interstate commerce.

 

Non Firearms are not regulated by the BATF. (Pellet and Black Powder guns are not regulated by the BATF because they are not considered firearms).

Speaking of "dicks", I purchased my Daisy from Ramsey Outdoor.

 

(it was an impulse buy.... I'm not proud of that fact)

Should have just continued on 17 north into NY and gone to Davis Sport Shop.

One additional thing to consider if buying an air gun out of state - don't get one that has anything that can be considered a "silencer", like the Gamo Whisper model.  Silencers are illegal on firearms in NJ.  Air guns are considered firearms, therefore an air gun with a "silencer" or any noise reduction device is illegal:

 

 

    The New Jersey Second Amendment Society recently obtained a copy of the letter from Lieutenant Joseph Genova, head of the Firearms Investigation Unit (FIU) of the New Jersey Division of State Police, that was sent to NJ firearms retailers regarding the legality of air rifles with internal or barrel mounted baffles designed to reduce noise. In this letter dated August 23, 2013, Lt. Genova makes reference to both air rifles being considered firearms under NJ statute, and that any form of “firearm silencer” is illegal in NJ.     For the purposes of enforcing New Jersey’s firearms statutes, air and spring-loaded rifles have long been considered firearms. According to this recent letter, any Air Rifles which incorporate noise reduction paraphernalia (specifically the Gamo Whisper .177, .22, DX models and those which are substantially similar) are now considered illegal due to the noise reduction capability.

    This situation has come to light as a result of questions regarding air rifles that are legal to use for hunting squirrel and rabbit in New Jersey. 2013 marks the first year the NJ Division of Fish And Game are allowing air rifles to be used for hunting. Prior to this letter dated August 23, 2013, Gamo and other brand air rifles with internal noise dampening devices have been sold to law-abiding NJ gun owners for hunting and recreational shooting purposes.
