Actually there are two options, one being better then the other.

 

1) you loose your "paid for" NICS fee and have the original FFL ship the gun

to another FFL who can make it compliant, and then they do your transfer

 

2) You original FFl send the gun out for Gunsmithing, where the other FFL does

the compliance work and sends it back to the first guy who does your transfer as

originally planned.

 

As a side note - you could ask FFL #1 to give FFl #2 your NICS approval number

(which is good for 30 days). You would just pay FFL # 1 the $15.00 bucks for his 

running the NICS, and give FFL #2 the approval number (Which he can validate

on the NICS system).

The NICS approval is per customer NOT per FFL - so once you have been approved, 

technically any FFL can use the number for that one transfer.

Jack, have you looked up an NTN after a proceed was given? I think all records are destroyed.

 

If I was the second dealer, I would be leary of the transfer without doing a NICS myself.

The 1st FFL should not have done a NICS check in the first place since the firearm was not NJ compliant and they couldn't do the proper gunsmithing needed to make it NJ compliant.  Thus no reason for the NICS check since they couldn't deliver the firearm.
