DC Handgun Carry Ban Overturned!

Recommended Posts

I'm just shocked at them thinking that criminals are going to legally purchase firearms specifically to commit crimes and that by limiting them to one firearm a month, that will reduce violence.

They have no such illusions.  The only reason they want to limit to one a month is to impose limits on the civil rights of others.  Their end goal has nothing to do with crime or violence, they want to deny (not just limit) you and I our civil rights.  It makes sense to start with RKBA, because then we can't defend our other rights.

Anyone have any thoughts as to this ruling helping our cause here in the PRNJ??? The way I see it,

D.C. had a total ban on any carry outside the home whereas NJ says "we allow concealed carry, just meet our

nearly impossible standards to qualify for a permit".

NJ is a no carry state masquerading as a may issue state!

Quote the ruling: In their complaint, Plaintiffs assert two claims for relief. In their first claim, Plaintiffs

allege that, "y requiring a permit to carry a handgun in public, yet refusing to issue such

permits and refusing to allow the possession of any handgun that would be carried in public,

Defendants maintain a complete ban on the carrying of handguns in public by almost all

individuals."

NJ requires a permit to carry, yet refuses to issue such permits in 99.9% of cases.

I honestly dont think anything can help us here....and as much as we dont like Christie, imaging another dem governor that wont veto all the retarded legislation..... just my .02

does that court have jurisdiction in NJ? if so...

No it does not.  But a positive decision may still provide some persuasive legal arguments should a similar case be brought in Jersey.  3rd circuit could go completely in the other direction, but this doesn't hurt as least and these judges tend to give more deference to each other than the lawyers and constituents in their own circuits.

If SCOTUS takes the appeal, that would be binding on NJ, but it is unlikely that SCOTUS will touch this.
