Hello from New York

Hi folks, I'm actually a resident and firearms owner from a neighboring state - New York.  Not sure which state is more oppressive with our second amendment rights.

 

Anyway, I joined this forum to learn more about firearms laws in New Jersey since my friend just moved to NJ and would like to get into the sport.  Specifically, I would like to find a definitive answer to whether or not I can bring a NJ "safe" firearm in a locked case from New York to a range in New Jersey without a New Jersey Firearms Purchaser Identification Card.  I've gotten yes, maybe, and no from people working at ranges, stores, and one retired PANY/NJ patrol officer.  By NJ "safe", I mean something like a Ruger Mini-14 Ranch Rifle with absolutely no evil features, as defined by NJAC 13:54-1.2 subsection 2i.

 

We're going to visit the New Jersey State Police station in Totowa to ask for their opinion on Sunday ... hopefully someone can give us a clear and concise answer.

IMO, this ^^^ is a complete waste of time.

1) NJSP is not obliged to provide you with legal advice.

2) Frankly speaking, NJSP is not always on top of all laws to provide you with _correct_ legal advice

3) (probably, most important) Imagine you get a _wrong_ advice. It will not be on paper with someones seal / stamp / endorsement, it will be not official. If you are busted and found in violation of something due to this wrong advice, explanation "Detective XXX from YYY told me that" will not really work.

As far as I know, you don't need to have FID to transport firearms directly to/from exempted locations. In simple terms, if I were you, I would have transported my long gun (after, of course, making sure it is not banned by name in addition to being compliant with all "evil features" regulations etc) unloaded in a trunk, in a separate case from ammo, directly to / from range without "unreasonable deviations".

If not trying to over-complicate things, I'd say that is pretty much it what you need to know... Maybe someone else will chime in with better advice.

Mikka1 has great points. Don't ask the NJSP and expect to be able to go by their answer.

 

Also, I believe if you are going to a NJ range then you need to be a member of said range and the range needs to have your name on their list for the NJSP to review. The other option is to go to an FFL which might just be located at the range you are visiting. Too little time to get the reference.

Welcome from Warren County, NJ!  Just curious may I ask what county in NY, as some counties are easier for CCW than others...  Would you say yours is "easier" or "harder?"

I'm in Nassau County on Long Island in New York. Nassau County has about a 18 month wait for a plain target pistol permit. CCW is not too common here, but not as bad as New York City.

Understood. I was thinking more Western NY State.   Refer to This Map of NY Counties and propensity to grant CCW's  One of the few times it's bad to be in a "red" area. :(

Sounds just like how all the different police agencies in NY responded about the SAFE act!

I checked the banned list and the banned features list. At least you guys get to have one banned evil feature! We can't even have a pistol grip on our semi-automatic rifles and we're limited to 7 rounds in up to a 10 round magazine, unless at a range, then we can have 10 in a up to 10 round magazine. Thankfully, Christie vetoed the 10 round magazine law for you NJ!

 

The above is exactly how I transport my firearms from Long Island to upstate New York, because New York City has that same exact requirement.

I hear you!  Everyone needs to let their voices be heard on election day.  I'm on a Long Island firearms forum and we're hoping Rob Astorino will be elected as governor and start overturning Cuomo's "SAFE" act that was passed overnight last January without notice nor review.

2C:39-6 Exemptions.

 

f.Posted ImageNothing in subsections b., c. and d. of N.J.S.2C:39-5 shall be construed to prevent

 

(b)Posted ImageDirectly to or from any target range, or other authorized place for the purpose of practice, match, target, trap or skeet shooting exhibitions, provided in all cases that during the course of the travel all firearms are carried in the manner specified in subsection g. of this section and the person has complied with all the provisions and requirements of Title 23 of the Revised Statutes and any amendments thereto and all rules and regulations promulgated thereunder; or

 

I pasted the above statute to show that you do not have to be a member of a club and have your name on their roster - it says "any" target range. You are GTG as long as the firearms are legal under NJ law and you go directly to and from the range.

Thank you for the correction. That's what I get for trying to answer with out re-reading the statues. It is sad that it is so convoluted here, but I'm glad it is slightly better then I originally posted.
