Gun modification affects Home Defense status

N.J.S.A. 2C:3-4 Use of force in self-protection.

 

(3) c. (1) Notwithstanding the provisions of N.J.S.2C:3-5, N.J.S.2C:3-9, or this section, the use of force or deadly force upon or toward an intruder who is unlawfully in a dwelling is justifiable when the actor reasonably believes that the force is immediately necessary for the purpose of protecting himself or other persons in the dwelling against the use of unlawful force by the intruder on the present occasion.

 

     (2)     A reasonable belief exists when the actor, to protect himself or a third person, was in his own dwelling at the time of the offense or was privileged to be thereon and the encounter between the actor and intruder was sudden and unexpected, compelling the actor to act instantly and:

     (a)     The actor reasonably believed that the intruder would inflict personal injury upon the actor or others in the dwelling; or

     (b)     The actor demanded that the intruder disarm, surrender or withdraw, and the intruder refused to do so.

     (3)     An actor employing protective force may estimate the necessity of using force when the force is used, without retreating, surrendering possession, withdrawing or doing any other act which he has no legal duty to do or abstaining from any lawful action.

Hopefully you will never need to use your gun for home defense. If you do, your gun should be stock and ammo should be something similar to what the current PD uses. 

 

Even if you are 100% correct and it was considered a justified shooting, the lawyers will try and find a reason to win the lawsuit that will be filed against you.

I load 100% tracers for home defense. M196 which lights up right out of the barrel. 60 rounds in a Surefire mag. I figure that will be safer if there are low light issues or sight problems.

So your concern is a civil liability case? Well if your state has a law that indemnifies you if you if no cause is found criminally, then you don't have a concern. But if you live in a state that has no protection, well where does it end? Do you not shoot IDPA classes because you will be painted as a person who practiced killing? Do you not use any humanoid type targets for the same reason? If the civil lawyer is going to paint you in a bad light, he's going to paint you.... In my opinion, just buy the ccw insurance policy and move on.

I think you misunderstood my point. Any standard handgun, rifle or shotgun loaded with standard ammo should do job of stopping an intruder.

 

If I'm ever put in the position of having to protect my family/myself, my main concern is our safety.

 

I was just stating that fact that most civilian shooting will end up in court because the intruder (if alive) or their family will probably sue you.

 

I'm sure the great republic of NJ would probably help them win the case.

Prosecutors wouldn't know a modified trigger if it bit them on the ass. You have a couple of choices if you have to waste someone on your living room floor. You can call the POPO and get cuffed and stuffed or, if you own an SUV or van, you can make the problem go away. Hypothetically, I know a guy named "Ricky" who bought a body bag at a gun show years ago. If he needs to send a miscreant to the next life, he'll deposit the body elsewhere, go home, have a beer, take a leak, and never think of it again. That's just him, of course. Most on this board would moan and roar and pee on the floor, then call the POPO and get ass hammered by the law.

Ricky will never do it because Ricky's the kind of guy who tells people ahead of time what his plan is.  These sorts of plans are worth having but only if you have the self control to keep it to yourself.  If you're going to brag, just call the POPO.

Also, for what it's worth, Ricky's plan fails to account for someone hearing the shots- neighbors, some guy walking his dog, the mailman (doesn't always happen at night), even the dead guy's wheel man, who can call the fuzz anonymously after speeding off,  etc.

 

Or, the same "witness" having already called Five-0 when they saw the ex-burglar breaking in.

 

It further ignores the dead guy's girlfriend/family reporting him missing and the iPhone location data showing an extended stop at Ricky's address. Or, that said dead guy already told his crew the he was going to hit Ricky's house that day. Which may not be a problem at first, until...
