Shipping firearm intra state to yourself

Recommended Posts

Looking to ship Interstate. NJ to FL and vice verse ( typo in subject)

Does anyone have experience doing this with

1) handgun

2) long gun

From my research is seems legal but the Fedex Rules may prevent it.

I think a long gun can be shipped via USPS but not a handgun.

I'm not sure about UPS on either handgun or long gun.

(a): FedEx will only accept shipments of firearms when either the shipper or recipient is a licensed manufacturer, licensed importer, licensed dealer or licensed collector and...

FYI - I have my C&R FFL so not sure if that would be a loop hole with the Fedex policy for shipping even non C&R firearms to myself.

UPS will ship firearms (Rifles definitely, not sure about pistols).  There are some rules though, must have adult signature requirement, no markings on box identifying the content of the package (can't have anything on the box indicating firearm inside), can't drop it off at UPS store or staples, must give it to UPS driver or drop off at UPS facility.

May a person who is relocating out of State move firearms with other household goods?

Yes. A person who lawfully possesses a firearm may transport or ship the firearm interstate when changing his or her State of residence.

Certain NFA firearms must have prior approval from the Bureau of ATF before they may be moved interstate. The person must notify the mover that firearms are being transported. He or she should also check State and local laws where relocating to ensure that movement of firearms into the new State does not violate any State law or local ordinance.

May a nonlicensee ship firearms interstate for his or her use in hunting or other lawful activity?

Yes. A person may ship a firearm to himself or herself in care of another person in the State where he or she intends to hunt or engage in any other lawful activity. The package should be addressed to the owner. Persons other than the owner should not open the package and take possession of the firearm.

May a nonlicensee ship a firearm by common or contract carrier?

A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

May a nonlicensee ship a firearm through the U.S. Postal Service?

A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.

I would use FedEx and ship to your dealer "Foster Guns & Ammo". :picknose:

It's legal. If you send a handgun, UPS and FedEx will insist it be sent Next Day Air. As a non-licensee, you may not ship a handgun by USPS. If you ship a handgun by USPS, you're committing a felony. If you ship a handgun by ground using UPS or FedEx, you're breaking company rules and they won't pay out an insurance claim if it's damaged or lost. Long guns may be shipped by ground without issue. What you may discover is issues with the receiving clerk. I've heard stories about clerks saying they need a copy of the recipient's FFL, long guns have to go NDA, hazmat applies, etc.

I have a friend who goes to Florida for the winter.  He tears down his pistols packs the pieces up and ships to himself care of his neighbor at his neighbors address in Florida.  Nothing special just UPS ground.  The neighbor knows nothing, accepts the package and holds it for him to arrive.  Picks it up from the neighbor and goes about his business.  Sends it back in the spring by using a call tag with UPS for a certain date at the neighbor after he is on his way back. He is home when the package arrives. Done it for years with no problems.  Why?  Don't know. He has a FL CCW, so transport should not be a problem but elects to do it that way.

How does he travel?  Air? Train?  Or by his own car?   If by car, does he have to stop (or pass through) DC? MD?  Those could be questionable. Even SC doesn't honor a FL CCW, according to Usacarry.com. But, otherwise, as long as he is passing through, does he not feel sufficiently protected by FOPA?

He meanders to Florida by car most times, never having an exact route or exact timeframe.  Likes to see the country on the way down and back.  Done it for years.  Reasons unknown.  Hell I even told him to change over to Florida resident but he doesn't want to. His choice.  May have to do with his retirement contract or something.  None of my business.

I wouldn't think it should matter if he's a FL resident or not. i He's got a FL CCW (I assume Non-resident, as is mine).  So he is covered in FL and the others states that honor a FL non-resident CCW.

While he's on the road, as long as he transports under FOPA rules, he should be OK. It all depends on where he needs to stop along the way. Like I say, I'd be concerned about traveling/stopping in MD, and I would definitely circumvent DC (i.e. just go right around the Beltway, or down the Del-Mar-Va Peninsula and across the Bay/ Bridge/Tunnel). But, otherwise, I would take my inventory with me. Like you say... his choice, though...

He's also breaking federal law when he does this as he's required to declare the firearms to the common carrier when he ships them.
