DC carry update

so does this mean that its going to be like NJ???  I wonder if she will be pressured to hold back on sighing off on them....  

I hope she gives them out like candy.

They cut and pasted from NJ's laws just as I said anti-gun states would,   Now what has to happen is for the first denial when someone puts down "self defense" or "second amendment" as a reason to fight it up to the SCOTUS.        The accepted reasons for approval will be constantly changing with every blow of the wind, Next police chief, Mayor, city council so on and so on.     So it looks like this is going to have to be fought again.

Beyond that, the ban in any carry in public transportation would effectively ban it for most folks from out of state.

 

It would affect most district residents too. 

 

What bothers me the most is this rolling gun free zone around dignitaries that they are proposing.

They are going to try.

 

Whether or not this is acceptable to the judge is a different story. 

 

They have asked for 180 day stay to enact legislation, the judge said no but he might accept a shorter stay instead.

It's hard to imagine why D.C. would not just copy the NJ procedure word for word.  It ostensibly allows for concealed carry and is a de facto ban.  The Third Circuit's ruling in Drake upheld the NJ procedure.  The D.C. District Judge would esentially have to adopt the Peruta analysis to reject the NJ scheme it or else just follow Drake and close the D.C. case.

You betcha! Exactly like NJ.

 

"Grudgingly" as they snicker and roll their eyes and protest too much. Nobody but nobody will get a permit except for a few well connected people.

 

Just like NJ.

 

Meanwhile if you've ever been to DC museums or other attractions you'll notice immediately that everyone wearing a uniform has a bad-ass revolver or pistol strapped to their side. Job descriptions that would not qualify for a government-issued flashlight in New York get to carry firearms at work.

 

They have to be prepared, you know, for when a terrorist decides to knock over the Washington Monument with his two scrawny arms or paint Frankenstein stitches on Rembrandt's self-portrait.

 

So much for the judicial branch.

More disinformation: "The other states where residents must show a reason to get a permit are Hawaii, Massachusetts, New Jersey and New York." Not in about half of NY counties or western Massachusetts, where you can get a permit if you simply jump through a few hoops. And not in NJ, where you can't get one no matter what your reason.

 

Calls for a letter from this particular NJ Herald subscriber.

Here's my letter:

 

The A.P. article you ran in the September 17 edition on Washington, D.C.'s new concealed carry law contained several factual errors. Contrary to what the article stated, concealed carry permits are relatively easy to obtain in most upstate New York counties, as well as in western Massachusetts, and forty-five other states. The writer identified New Jersey and Hawaii as "may issue" jurisdictions but in fact obtaining a handgun carry permit is impossible in either state unless you are a retired law enforcement officer or politically connected. Same for Maryland, which the article did not mention.
 
D.C.'s new law, which is patterned on New Jersey's, ensures another round of legal battles while changing next to nothing by thumbing its nose at a Federal Court ruling. The D.C. Council is cynically hoping that the legal challenges to their non-compliance will outlive the judges who overturned their handgun ban. 
 
Meanwhile the firearms murder rate in D.C., with arguably the most draconian gun ban in the nation, is more than double that of the next state on the list, and six times that of the U.S. average. Virtually all such crimes are committed by individuals who obtain guns illegally. The laws, such as they are, only affect -- and punish -- people who actually care about following them. For serious violent criminals the gun charge is either pleaded away, or the sentence is served concurrently with a lengthier one for murder, assault, robbery, etc.

well we have a court ruling that covers that now don't we?  if the dignitaries jobs are too dangerous, they can always switch jobs.

Lanier most assuredly won't be "giving them out like candy" at least if she wants to keep her job.

 

The real fly in the ointment is Congress, any law passed by the city council is a suggestion and congress gets to review it.

Te article mentions that anyone caught carrying in one of these Mobil zones would first have to be asked to leave, and refuse before they could be detained
