The animal is roadkill right? How is that poaching?

Believe it or not there are people that exist in Murica that will run nice looking bucks down with their trucks for the antlers. That's poaching, that's what the law is intended to prevent. Without an appropriate harvest tag for the deer it's illegal to be in possession of the antlers period. If you hit a deer with your car and wish to recover the meat you can call the local police department for a road kill tag. That entitles anyone to take the meat from the deer. But the head has to be surrendered to fish and game if it's antlered. The only way to aquire antlers from deer in NJ is to get a hunting license and work for one in the woods by legal method ie: shotgun, bow/crossbow, or muzzle loader. That's it. There's no 2 ton killing machine season. If there were believe me people would be doing it.

Seriously? Running down a deer with an auto on the road? Pretty fairytalish. I've issued several tags for hit deer. The copies were never collected by F&G.

You ever been to upper Sussex County? Not a fairytale, it's deliverance bro! They're spread so thin at the division unless there was a specific reason to collect the tags I can't imagine they care about them. But if they had a case they were investigating and it involved a deer with an issued road kill tag they would be by the station to pick up the paperwork for sure.
