Shipping a firearm made before 1889 from NJ to another state.

I know that federally the government allows shipment of firearms made before 1889 to personal parties, no need for FFL. However does NJ have any special state law restrictions with this. Can I ship a dissasembled handgun made before 1889 to an individual in another state?

I believe you can ship it to a non-ffl, that non-ffl just can't be in NJ any other states that don't recognize antiques.

Think this through. 

 

Since NJ doesn't recognize antique exceptions to handguns, the process of taking the package from your house to the post office would be possession of a handgun outside of any exemption.  If the postal employees cause an issue for you (and never assume they have any clue about the postal rules around here), you could find yourself in a situation where you are in possession of this thing outside your home and caught. 

 

If you are selling this item, then you trigger another problem because it is illegal to sell a handgun in New Jersey without signing a purchase permit.  Yeah the buyer is outside the state - doesn't change that the seller (you) is in NJ and subject to NJ law, and therefore you are open to getting caught for selling to a buyer who does not have a purchase permit.

 

It isn't likely you'd get caught on any of these nonsense violations, but they are severe.  I wouldn't risk it.

 

If you wanted to truly protect yourself, you might want to consider driving to a Pennsylvania gun range (in exemption) and then mailing it from a post office in Pennsylvania, where there should be no problem.  Or going to a NJ dealer and having the dealer ship it to whoever is receiving it.  The money saved isn't worth the risk considering these are felonies.

That's why I asked here. I was pretty sure NJ had it's own special rules on antiqure firearms but I wanted to confirm. Thanks for the info guys.

When I was attempting to purchase pre-1898 firearms I was told but numerous dealers they wouldn't ship directly to me unless it fired a caliber no longer commercially produced.

 

IIRC NJ considers pre-1898 firearms just that...firearms..

 

I would recommend having UPS, FedEx or USPS pickup the gun and would advise against boxing it up and driving with it.

 

And yes you can ship it to a non-FFL holder in another state

If I needed to ship a pre-1898 firearm I would box it up and have UPS, FEDEX or USPS pickup the package from my home. Leaving your house with it and not going directly to a gun store or a range could invite legal problems./
