Carry ammo for out-of-state CCW

Recommended Posts

I'm about to apply for either my Utah, Florida, or Virginia CCW. I travel out of state a fair bit to visit family, and would like to carry when I do so. The problem, then, comes with transporting self defense ammunition to and from home.

I just read Brian Aitken's book, "The Blue Tent Sky" (http://www.amazon.com/dp/B00N19KDM2), and saw that in the end, he got 2 of the 3 charges overturned based on the exception for moving. The one that didn't get overturned, transporting hollow-point bullets, wasn't covered under the "moving" exception in the law.

So, I want to know what my options are. Are there reasonable defensive loads in FMJ that I should look at? What about something like Federal Guard Dog -- it doesn't look like a hollow-point, but it is expanding. What does the law cover here?

I also have like 1000 rounds of hollow-point .22lr that I bought without realizing. Should I get rid of these? Is it legal for me to transport them to/from the range?

Don't get too paranoid about it.

If you're on your way home, just tell them you're on your way home.  If you're on your way out of state, just say you're going to a range out of state.

I have been partial to Hornady Critical Defense/Critical Duty.  They perform better than Federal EFMJ/Guard Dog (better expansion).  The tip is polymer filled so they aren't considered to be Hollow points.  PK90 had a letter from the NJSP regarding it.  I think I have it saved somewhere...

When I go to delaware and carry I bring Guard Dog. You can take hollow point to and from the range so enjoy them 1000 rounds. Now if you go to move pack up your car with these rounds and drive to the range. Then when you leave go to your new home. You're then in the law of traveling to and from the range. Silly but that's how I would do it if needed.

Expanding, whether hollow point or not, are covered by the same NJ law. Guard Dog, Critical Duty, Critical Defense, EFMJ are all designed to expand more than a normal bullet which makes them dumdums. Dumdums are restricted exactly the same as HP. You need to observe the same exemptions for either.

Any NJ case law out there of someone being prosecuted for Dumdum possession and *NOT* hollowpoint possession?

The Judge in the Aitken case took it upon himself to make the definition of dumdum to be any bullet designed to expand more than normal. I do not know of any case following that where the definition has been cited.

Other than the above in the Aitken case I was under the impression that polymer tipped bullets were OK'd by NJSP. Which I find strange given the stance NJ takes on anything firearm related. I'm not sure where the NJ legal system finds a definition to be "the definition" but try googling dumdum bullet..... Don't look a gift horse in the mouth
