dobie 0 Posted January 29, 2015 Now admittedly I don't know a lot about this issue but am I correct that the reason we don't have gun shows in NJ is due to the so called gun show loophole. I was just reading an article about the myth of the gunshow loophole which basically states that FFL's are still required to do NICS checks at gun shows so that whether they're in their store or at a gunshow that have to the same background checks and maintain all the same documentation. The so called loophole would only cover the individual (non FFL) who rents a table and sells from their collection. Is any of this correct? If so why can't you have a gun show that allowed FFL's to sell? What exactly is the law re: gun shows in NJ? Quote Share this post Link to post Share on other sites

I have lived in TN, as well as PA and NJ, I have worked for dealers in TN and PA, and at many gun shows, for many years. In states that do not require FFL interaction to transfer a Handgun (TN) people can indeed buy and sell hand guns with out the use of FFL. These indeed are pre owned not new firearms. In states that require you to use an FFL to transfer handguns (PA) the FTF sale of said handguns is illegal, and in turn not done without the interaction of an FFL. Trust me, as an FFL we were often asked to perform said PICS check for individuals looking to sell their personal product to another individual. This whole "Loop Hole" thing would have to be explained to be, as again. I think its media hype once again ignorantly portraying false info. As for, why no GS in NJ. Probably because, NJ hates us! Its not a loophole, the laws don't change at gun shows. mipafox 438 Posted January 30, 2015 There is no such thing as a "gun show loophole" in any state. I am unaware of any state that has laws less strict at a gunshow than elsewhere. The federal government used an "FFL Loophole." 20 years ago there were no required background checks at FFLs. Only states that had licensing systems of their own (such as NJ) had background checks in some cases. When the Brady Law was proposed, they knew it was completely unconstitutional to require people to get permission from the federal government to own or buy a gun from inside your own state. So they came up with an "FFL" loophole. People in the business of selling firearms had already become federally licensed as FFLs. So the federal government realized they could pass legislation requiring their licensees to do just about anything they wanted, including perform background checks on all purchase of firearms from FFLs. I realize my Senator Toomey and Manchin sponsored a Federal Universal Background check bill. That doesn't mean it's any more legal now than it was in the past, it's just an example of incremental Progressivism. Pass laws that violate the Constitution, take the ones that are not challenged or are ruled legal by Harvard Progressive Judges and then build on those precedents later step by step. maintenanceguy 508 Posted January 30, 2015 NJ doesn't have gun shows because FFL's are only allowed to conduct business at their permanent location in NJ and because it's illegal to transport firearms too or from a gun show. The "loophole" is simply the fact that it's legal in America to buy and sell a firearm privately without going through an FFL.
