Will the M855 ban make us felons in NJ

NJ law makes it illegal to possess any ammunition capable of penetrating body armor that is primarily for use in a handgun.   Federal law prohibits the ammo if it's a handgun round.  The AFT is using AR handguns as part of their justification for banning green tip ammo. 

 

So, does that mean that green tip ammo is now handgun ammo and that we're all felons in NJ?  

 

We'll probably find out when the first guy is charged. I figure his daughter will file a restraining order against an abusive boyfriend.  The local Sheriff will show up with the jaws of life to cut open the gun safe.  They'll find a box of ammo and the local prosecutor will decide he's a danger and needs to be put in prison for many years.

Its not primarily for use in a handgun, so common sense would say it is ok in NJ. Of course there is no such thing as common sense in NJ...

M855 does not meet the federal definition of armor piercing.

 

M855 is not primarily used in a pistol - it's a rifle round.  The fact that .223/5.56 CAN be used in a pistol (and they have been for many years - single shot pistols like the Thompson Contender) makes no difference.

The truth is, I feel like we're now in the post-rule-of-law era where it no longer matters what the law actually says. It matters what the regulatory agencies, prosecutors, and judges wish the law says.  Just because it's not armor piercing doesn't mean it's not armor piercing.

 

Ayn Rand was right.   2+2 really is starting to equal 5.
