So... 1 - It's not a fully automatic SMG 2 - No silencer, just a cosmetic feature to hide the barrel. However, if he illegally obtained the gun and has a criminal record and was committing a crime at the time he was arrested. No worries, they will throw out the gun charges and he will get parole!
