HP Ammo for Home Defense

Took a NRA pistol course and there was debate whether hollow point ammo is legal to use in an otherwise lawful exercise of self defense in ones home. Some maintain that while its legal to possess HP ammo in one's home, it's unlawful to use it. What's the consensus here?

100% legal. I wish those that instruct would only do so on topics on which they are knowledgeable. Obviously your instructors are not conversant with NJ firearms law which calls into question anything else upon which they expounded.

Read the title of post and figured you were going to say you were at Bass Pro Shop and they told you the HPs and powder were illegal in NJ.

 

There was A post on the Smith & Wesson forums from A employee.  Stating that BP says they are Illegal.

 

As posted above.  HPs are legal in your home and for transport to and from the range for practice.

Just please dont leave even A rd of 22LR HP accidentally in your car or truck.

Please tell us where you took this course so we know to avoid this fountain of mis-information.

If it gets to what type of bullet you used to shoot an intruder in your home you are already in trobule. Be knowledgeable not familiar with use of force under 2C. Read ALL of the parts of the statute.

 

Many say don't talk to police when they arrive. Remember, you are going to have to make a statement (hopefully before a trial) that you were in fear your life and the lives of your family if you are claiming self defense. If you don't know what to say say nothing. You may stay longer in the process but it will help you. Remember there have been several justifiable shootings in NJ recently and the citizens defending themselves were not led out in chains.

Well that's unfortunate the instructor was unfamiliar with NJ law. Hollow points are legal to own and use in your home and at the range.

Yes, that is also my understanding.  I examined the statute and the exception.  It does not expressly speak of use of HP at home but does not declare it illegal either.  I've found no case holding that the use of HP ammo in an otherwise lawful self defense situation in the home is illegal.

I'm going with legal to use. If you happen to magically get a nj carry permit then you cannot carry with HP. So legal to purchase, own in your home, shoot at the range or home. Illegal to possess them outside your home unless in exempt locations like the range. Oh and if you move to a new home don't transport them to the new home along with everything else you own. That too would be against the law...

Your home is an exempted location. How is it illegal to transport your HP ammo from your home to your new home??? I don't get it???

I was told the same thing at the First Steps class at the Atlantic County Pistol training facility. I and another student had to correct the instructor.

When did you take your class and who was your instructor(s)? I taken first steps and Basic pistol at ACFTF in the past 2 months and it was clear they understood HP where not illegal (under the approved conditions set forther under the laws, etc.) And that it is a huge misconception people think HP is illegal in NJ.

It was within the last month. No need to name names. Their mistake was explained and corrected. I would hope they won't make it again. And actually it was during the basic rifle class. I had to take both classes in order to be able to shoot my pistols and long guns there.
