Open Carry might not pass in Texas after all.......

 

Open carry in Texas might be shot down...pun intended. The sticking point seems to be an amendment that would prevents cops from stopping OC carriers to see if they have a valid concealed permit. The reason for the amendment was so that minorities would not be singled out if they were OC.

 

However Austin's police chief is against the amendment because he claims it would create unlicensed open carry. The police chief is described as having "no respect"  for the second amendment and is originally from California, which might  answer some questions.

 

If this all falls through, unfortunately it will be another two years before the bill can be introduced again. Or... if the Texas Governor can call a special session to deal with the open carry legislation specifically.  As they say..stay tuned. This might go all the way to the wire, as the old saying goes.

"Five senators and representatives will have to reach a compromise in the language of the bill that both the House and Senate agree upon. If they can’t agree, the legislation is dead. If they agree, the compromise legislation must then be approved in new votes by both the House and Senate. They must do so by Monday. If both Houses fail to pass the legislation, or the session expires, the legislation is dead."

Yeah, great gun laws they have there.

 

 

I know, I tell that to new and would be gun owners all the time. When I was down there in January I was always reading up before going anywhere down there.No open carry of handguns, but you can with rifles (kind of), No bar carry if 51% of their business is from alcohol. Then there's the 30.06 gun signs---you could be prosecuted on private property even if you're a legal carrier. Then the "no guns allowed" that adds to the confusion, then felony for CHURCH carry and add on top the training requirements, etc. I find it much better in PA, NC and other states.

In Jersey I would believe it, but in Texas I find it hard to believe police would be against this. When "police" speak out on gun control, it's rarely the consensus or real cops. As demonstrated by the Police One survey.

 

It is funny that unpermitted open carry is legal in dozens of states and police can't detain anyone or demand ID for it, and everything is just fine. But Texas is the one place where it would threaten the safety of police and the Citizenry.

It's not "The Police"...it's one Police Chief in one city. That city just happens to be the state capital and the PC is a commie prick from Kalifornia. The rest of the state, for the most part, looks at Austin with scorn and disdain. It's considered the San Francisco of the south and most real Texans try to stay as far away as possible.

In order to get compromise between both houses of the legislature, they removed the portion that said LE can't stop someone who's OC just to check their permit. So, when Gov Abbott signs it, it will go into effect on January 1, 2016 and police can stop anyone who is OC and verify that they have a valid carry permit.

Texas law are very interesting... When I took the TX CCW class we reviewed all the scenarios where your could use deadly force. The one that stands out for me had to do with trespass and mischief.

 

The example went like this. If someone was on your property letting air out of your car tires during the day you could not use deadly force. But if done at night you can use deadly force.

 

Apparently they give you extra leeway at night since it is potentially harder to distinguish between a mischievous act and a deadly threat?

 

You could basically shoot any trespasser at night.... They took " stand you ground" and put it on steroids...
