Juvenile arrest question

Recommended Posts

Back in 2000 I was arrested when I was 17. Not exactly sure of the charge, currently waiting to hear from arresting PD. Possibly trespassing, I honestly can't remember. I was brought to PD and released to my parents. No fingerprints or typical booking procedure. Chose option of meeting with what I believe was a juvenile PO to have record expunged. Had to observe 20 hrs of court and write an essay. Successfully completed and assumed everything was scrubbed.

Fast forward to today, applied for change of address FID. Detective called, saying I have a record and my permit may be denied. I was shocked to hear this as I already have a FID card as well as have gone through the change of address process once prior, all without any complications.

I also hold multiple state professional licenses and a federal DEA license and there were no mentions of a record in those processes. I am confused as to why this would show up now and be a problem, but never with any of my other background checks.

What gives?

I would call that Detective back, call his superior or call the NJSP firearms unit. This Detective is either playing games with you or does not understand the law.

NJ has disorderly persons (aka misdemeanor) and crimes (aka felonies). An arrest, or a disorderly persons conviction for a non-violent offense is not grounds for denial.

I did something stupid as a young man that resulted in a disorderly persons conviction. That has not prevented me from getting my fid and many, many handgun permits.

Call soon, because if they deny you and even if you win on appeal, you will need to say you have been denied on future applications.

Good luck.

Isn't there some bogus catch all along the lines of issuing agency has to find the applicant "to be of good moral character" as part of the process?v

Edit: I must have been confused just read all through njac 13 and couldn't find it......I might have gotten a local pd summary of the requirements with pistol permit application which was worded that way...
