SAPPA flies motion for default in Federal Court today

For those who want to stay updated on this, here's the report:

 

THURSDAY, AUGUST 13, 2015 - Today Dwight and Nick took a drive to Trenton, NJ where we filed the Motion for Default with the Court Clerk.  This motion, if the standing rules of the Federal Court System are not ignored, will require a ruling from the Court which will prevent any further filings in the defense of the government defendants.  These include the Governor and all of the legislative defendants.  By rule, when they failed to comply with the Court Order to present a defense in a particular time frame, they automatically lost any right to request an extension of time nor will they have the right to present an opposition paper.  Under these Federal rules, not even the Judge assigned to the case has the authority to allow further litigation.

 

The only two defendants who are still actively able to continue to defend their actions are the two Retired Chiefs of Police from Northern Jersey.  Their attorneys did file in time and Mr. Purpura is now preparing his reply brief to their opposition filing.  However, since the opposition filing they presented to the court is so lame and failed to follow Federal guidelines for opposing civil rights violations and breaches of the Rico Statutes, a reply brief to it will be quite simple.   More on that in the next update.

TUESDAY, SEPTEMBER 22, 2015 - Nick worked almost around the clock researching the references the Defense Counsel chose to use in his motion.  Even as, from point to point he couldn't believe the  lack of coherence and the very weakly prepared defense which comprised of their motion, each point nevertheless had to be addressed.  The editing process and the finalization of our response was completed late Monday.  Prepared also and to be submitted with the Reply was a cover letter which Nick addressed directly to Judge Shipp.  It is a powerful letter.  Also, working with Joe, one of our most esteemed SAPPA Group members, a chart was prepared that would make a visual statement reinforcing Nick's RICO violations allegations.

This is a terrific endeavor you SAPPA folk are undertaking and I've been following it. Thanks so much but everytime I get myself updated i cant help but get my shorts all bunched up thinking this is excactly what our state NRA rep should be doing(and why you are).... they're good at grabbing the easy low hanging fruit but nothing like this... but I digress, good luck,thanx again for your efforts!

Just another example of lack of leadership. NRA has given up on NJ, except to cash our membership checks. Instead of pooling resources towards one or two sensible initiatives everyone is going his own way, and some aren't going anywhere at all.

if the nra would back them on this endeavor.......it'd probably guarantee a win for us. but....then they'd lose some of their moneystream, as they wouldn't have anything to panic us about.

 

 i als wonder if having a list of signatures of people that want this shit changed would help....'cause there's a bunch of people putting a bunch of effort into getting a bunch of signatures.

I think everyone should remember that the special aspect of this case is that it is being brought by a citizen, NOT an attorney. In cases like this the court takes that into consideration and is usually accepting of the grammar, spelling or other small errors.

As I've asked twice, would be nice to get behind this initiative if we knew WTF it was all about. I'm still clueless.

Nick Purpura is suing the Government of New Jersey, who have installed laws he calls unconstitutional,as well as the courts (Judges) that have affirmed these laws( State and Federal, on both the district level and the appeals court level)  and the law enforcement community which have enforced these laws.  He is using the violation of civil rights/Constitutional rights as the basis of his suit.  By filing as an individual it gives him standing as individual Constitutional rights violations always have to be heard.  He is using the RICO statutes to go after politicians that can usually claim immunity by being an elected official just doing their job.  When included in a conspiracy they lose that immunity as there is no excuse to conspire to violate civil rights; not by a judge, governor, or any other public servant.  If you read the brief, I know it is long as I have read it more than once, you will get the sense of what he is doing.  He puts forth 7 areas where he is seeking relief.  I will list them below:

 

FIRST CLAIM FOR RELIEF             Civil rights violations to achieve gun control                                                                                     

SECOND CLAIM FOR RELIEF        Conspiracy to interfere with civil rights violates   42 USC 1985/86

I believe a win on any or all of the requests for relief will amount to a win for Nick and all of us.  There are simply 7 different reasons why he should win his petition.

I don't believe that -- I believe there are lots of places where this might fail. But let's keep our fingers crossed.

Nick is certainly expecting the courts to do their best to dismiss this complaint. The hope that it will end up at the Supreme Court. If it does, and they hear it... He can't lose. So he says and I believe...

For him to win, the court has to agree that civil rights were denied.

 

Given that none of the cases to date have bothered any of the courts up to the circuit level, expect the same yet again. Then scotus can decide not to hear it.

 

You can bring a suit over a conspiracy to create strawberry jam, but it won't do you much good as it's not a violation of the law.

 

The only thing that is a must in this process is that RICO attaches a degree of long term peril to the named individuals even in a loss. However it won't be real peril. The only likelihood of that coming around is if an incumbent party used it to seize the assets of someone running under RICO. That be the end times for politics putting that out as a strategy. It'd be highly telegraphed and mean everyone goes for their nuclear options.
