7th Circuit says 2nd Amendment right applies to illegal aliens!!!

Recommended Posts

I think people insult the principle the country stands for when they beat their chest and claim to love the Constitution but then claim some people are more equal then others by virtue of their birth. Having grown up listening to Voice of American in dark rooms, and reading banned copies of Animal Farm, you might see how I feel disgusted by some of the comments in this thread.

Sorry, you feel that way. But when it comes to rights given by man for man, we are not all equal. You're mixing things up. If a law is written restricting one group of people from doing certain things, we are not equal. You break the law, you pay for it. Don't like it, change it. If you support an amendment change to allow everyone to come to America without having to follow the laws, then vote for those who would change it. I feel that people who come to this country illegally have no rights granted by the laws of this country. And if a fence and/or an armed force at the border can prevent them from entering, I am all for it. They are welcome to come in, but they must do it the legal way. If you are here illegally, you should be forced to leave.

We are all born with natural rights but those rights are not unconditional. The USA does NOT have open boarders (though one would never know it) and we have Immigration laws.

People who break laws loose some rights.

Should illegals have the right to vote? Run for president? Work without a proper visa and not have to pay taxes?

Are illegal immigrants granted MORE rights than US citizens? It sure as hell seems that way.

When the constitution was written, we DID have open borders. We weren't founded with ins in place.

We are defending the GCA now? Also apparently the GCA is wrong according this court decision. Since when do we really want to oppose the dismemberment of the GCA?

Maybe I missed something. How is GCA wrong based on this decision? Not that that's a bad thing, just curious.

Every Freeman must be awarded tools to defend self - verbally, legally and physically.  Unless placed under ward, every man and woman are Free, hence carries aforementioned protections.  There should be no further restrictions as to specific Class, Status, Citizenship etc.

People under certain age, mentally ill, fugitives and few other categories that can legally (and morally) be clarified as being "ward of....". Well, they dont get same rights.

Next, Is an illegal immigrant ward of the Govt. ? For that, timely due process must be awarded so the status can be concluded (we know all how thats being abused, but thats another matter).   Once the Person is declared illegal immigrant, they become ward and should face the punishment immediately (unlike how people abuse it and stay forever while the cases rot in courts).  Obviously, they dont get same rights either.

Problem with GCA (and some other laws too) is that they do not apply the law fairly and equally.  Why prohibit someone from 2A if the person fulfilled punishment and now a freeman in the society ?  Why prohibit someone who denounced citizenship earlier but now legally in the country ?

In Summary:

Freeman - all rights

Ward - restricted, deport, jail etc

Thats how its supposed to work anyways.

Because the GCA as mentioned in that link says illegal aliens can't posses guns, and the 7th says they can. As such, this decision overturns part of the GCA, does it not?

This decision, as I understand it, upholds that illegal aliens cannot possess guns. But strikes down that the 2A does not apply to them. Like the rest of us, the 2A can be constrained. Like if you're here illegally, a felon, or a citizen of NJ.
