sellling long rifle to PA resident

You dont need a copy of the PA FFL's info in the box... You will need a copy of your DL in the box along with the buyers name.

 

1. Dont leave it loaded and do not ship ammo with it. ( I Know but i had to say that)

2. Make sure the FFL its going to will accept a transfer from the private party, Some do not.

I have the reverse of this situation. I want to buy a long gun from a PA Resident. He doesn't really want to drive into NJ (can't blame him) and I am willing to go to PA. I have purchased multiple long guns from PA Residents in the past and met them at PA FFL and FFL did transfer. I had to fill out the same paperwork as NJ and show my DL and FID. PA FFL ran background check and transfer was done at a cost of $9 at one place and $20 at another. The problem this time is the PA Resident is right outside of Philly and multiple FFLs I called said they can not transfer long gun to NJ Buyer. I believe this info is incorrect based on the FAQ and past experience. Can someone please clarify. Also while on the topic of purchasing long guns I found online a SA58 Rifle for Sale. Is it banned by name under FAL Type in NJ? If not it seems to pass the evil feature test there is no Bayonet lug, grenade launcher, flash hider or adjustable stock only the magazines are 20 rounds but seller is willing to sell w/o the magazines.

Legally, that is fine. You would have to fill out a Certificate of Eligibility (ones that regularly do NJ transfers, Cabela's for example), and them do the NICS check. If they don't want to, that is there own decision... as they don't want to be responsible if the gun isn't legal here. Similar to some FFLs not wanting to receive from a private individual. Not illegal, but they don't want to deal with having to get a copy of a driver's license from people that forget to send it.

 

With the exception of guns banned by NJ law, the only thing a NJ resident cannot buy out of state is a pistol. Federal law requires they be transferred from out of state by an in-state FFL. You see NJ FFLs go to the Oaks gun show to take possession of handguns from PA FFLs and transfer to NJ residents (legally).

Thank you for the clarification. I thought maybe something was different in Philly or something changed. Three stores were insistent that buyer had to be from PA. The transfer is for a bolt action .22 rifle which I explained to all of them, but they all insisted I was incorrect.

It's funny you say that I used Cabela's as an example and even asked what if I were to come into your store and purchase the same rifle? One of them said they would have to ship to NJ FFL and two of them said it was OK because I was purchasing it from them direct. Which made zero sense because if theu believed that to be the law; why couldn't they buy the rifle from the PA Seller and then Re-Sell it to me as a NJ Buyer? I ultimately found an FFL South of Philly who has no issue with doing the transfer.

Clayton's in Horsham. PA right off the Turnpike I usually use for PA PTP transfers. They charge $20 total for NICS (I think PA uses PICS) and transfer. They also have an indoor range which allows every except 50 BMG. I will update if all goes well.

    • I very seriously doubt this has anything to do with terrorism.    1) Harbor pilots are VERY seriously vetted, and highly trained. Not to mention extremely well paid. My experience knowing a few of them, and knowing how they are recruited and screened tells me that there is a slim to highly unlikely chance that a harbor pilot would have participated in anything like that.    2) Maintenance of foreign flag ships is well known to be dubious. Especially these days. These were NOT US flag, Jones act sailors. It was (to my understanding) a largely Indian crew on that ship, with a Ukrainian Captain. Indian crews are not exactly known for being stellar.    3) The bunkers (fuel) these ships use is ‘Bunker C’, which is a heavy, dirty fuel oil that can, and usually is, pretty contaminated. This stuff ain’t your car grade gasoline or diesel fuel. It’s nasty.   It requires nearly constant filter changes and maintenance to the engine/generators. The ship took on fuel prior to departing port, which would stir up all kinds of shit in the fuel tanks, which would contribute to particulates in the fuel lines/filters.    4) I’d say the posting of the chief engineer for Maserek above was pretty spot on as far as chain of events.    This was a shitty accident, with horrible timing and outcome. Not a terror attack.
