No Way Out: Feds Stop Processing NICS Denial Appeals

Each year thousands of Americans are wrongfully denied their Second Amendment rights when the FBI’s National Instant Criminal Background Check System (NICS) incorrectly determines that they are prohibited from firearm ownership. Compounding this grave injustice, this week the FBI made public that they have stopped processing NICS denial appeals.

I love how they can just decide to stop processing appeals. What's next? Are they going to decide to stop processing NICS checks altogether?

 

How did AMERICA get this way? We used to be the country of freedom, liberty, and fairness. This country was founded because people were sick of government abuse, and we are letting this kind of stuff happen?

Err before we all march on the FBI, it is actually probably not their fault. If you read the US Today article you find that they are simply understaffed, seeing how we have more then doubled the number of NICS checks but not the staffing. As a result of insane number of sales leading up to x-mas they shifted their appeal people to have more people doing background checks so they don't run over the 3 day limit.

 

I don't like it, I think the system is broken, but I don't the FBI is at fault here, nor do I think it is nefarious.

I don't like it, I think the system is broken, but I don't the FBI is at fault here, nor do I think it is nefarious.

So what if they are understaffed?  Imagine what would happen if they used that excuse for welfare checks not going out in a timely manner, or disability, or social security, or just about anything else the Government does.  Tell them to hire more people and eliminate expenses for other crap the government should not be doing.  I'm sure we could just fire most of the staff at the Whitehouse as the inhabitants have total contempt for them anyway.

Ding ding ding, we have a winner!!

First we bitch that Obama's EOs are unconstitutional. Then, following an EO that allocates money to hire people to process NICS, we say it's so he can keep us from buying guns. Now, the FBI is so understaffed that they can't process appeals, of course that's part of Obama's master plan to take our guns.

The paranoia runs deeper every day.

perhaps i'm slightly paranoid.....but this could be part of the plan?sure they're understaffed. 1st step, they stop processing appeals. as the nics requests continue to increase, without the corresponding staffing increase, a form or rationing could appear. they could decide to "rotate" which states requests will get processed as they go. if the ubc thing gets passed, they could decide to not run person to person checks at all seeing as they're overloaded with those from ffl's.

 

 this may just be an innocent happening........or it could be bad.

For what is worth...

A NICS is not required for every firearms purchase.

If a state has a vetting process that qualifies with the FBI the state can use it's own vetting.

For example: If I have a SC CWP (and I think NC does this too) no NICS just fill out, just file a 4473.

 

So if NJ qualified their vetting process for their FID with the FBI they could eliminate their $16 NICS

Christie would never allow it. That might make it easier to legally obtain a firearm so he'd do anything to stop it.

christie might allow it....probably not.....but might. sweeny? when he's governor? nearly every firearms owner in the state will become criminals at the swipe of a pen and almost overnight.

If you really needed one you could go to any gunshow not in nj or pa and simply buy it.

Could even ask Eric Holder to buy it for you and simply give it to you outside the nj borders, perfectly legal because the government does it, I think.

Got to be legal if they do it , right?????????????????????

I'll play devils advocate some more .. Imagine they let the 3 day limit pass by on lots of people which then went and bought guns and ended up being actually prohibited persons that went on a rampage. It would be bad for us gun owners because of the image, and imagine being the FBI person who decided to go home at 9pm to see their kids only to later find out if he worked a bit harder or ignored her family she could have prevented a massacre.

 

I'm not saying this is a good development, I'm saying it is probably not some grand conspiracy so we should probably try to not make everything into a fake moon landing if we want people to not say we are crazy gun nuts.

But, EVERYTHING is a grand conspiracy on this forum. There's some good knowledge on this site, but the paranoia is pathetic. So many posts with fictional "facts" that were conjured up to support one conspiracy or another.

Many here think we are losing the battle, and maybe we are, but it's our own damn fault for believing the bull$#1+ they've been feeding us. We buy the "Obama wants to take your guns" thing hook line and sinker and defend Christie while he takes our guns because "Sweeney would be worse." Newsflash, Sweeney isn't the governor, yet, and he doesn't have to be. It all depends on who we get behind. NJ is a blue state, we are one of the most affluent states in the country and are above average in education. That is the demographic of a blue state. The idea of a truely conservative Governor is not realistic and if that's who you support, you may as well be driving Sweeney's uhaul to Drumthwacket for him. Find a moderate, from either party, who respects the 2nd amendment and you have a chance. Find a pro-2A democrat and you might even have a good chance. But a far-right Governor just isn't going to happen without a lot more trailer parks.

Cmon.. The Internet is founded on conspiracy. Porn and conspiracy theories. The entire internet is loaded with what people would call crazy people. It's tailor made for it. So please don't expect it not to thrive.

Oh no dude, that one is real for SURE. Obama moved back to Hawaii in 1971. Hawaii produces lots of coffee. Starbucks was founded in .. 1971.

I studied how fbi background check worked up to 2008 while I waited for 5-6 years for my check to complete for immigration. Congressmen and First Lady could not help because by law background checks do not have time limits. There are several notes:

 

- I had supposedly best immigration lawyer in New York. Thing is lawyers do not fill your documents. Paralegals do. And my specific paralegal made every possible mistake in forms you can make. If FBI really paid any attention they had to dig through all those mistakes to get to the truth :) I only imagine what less than best lawyer offices do.

- fingerprints had very short life span before they are backed up to magnetic TAPE storage. FBI could not physically retrieve those records unless there was a high profile criminal investigation. So, I had to do my fingerprints every 3-6 months. I guess it was every time FBI touched my case.

 

There were many other inefficiencies and waste of money that were reported regularly by GAO. Like spending $150mil or so to a new fingerprint database and then discarding it because it did not work.

Doesn't Jersey have it's own NICS? Here we have PICS. They access federal data but the feds do not make the decision, PA does. If you appeal, you appeal a PA denial to PA, not the feds. Would have thought it was the same in Jersey.

 

Still, even more unconstitutional than what they were already doing.
