Ruger Charger 22-10 Pistol 22LR

The pistol is a no go for NJ. As per the NJSP here's the definition of a assault pistol is:

section 2c:39-1.ii

A semi automatic pistol that has the ability to accept a detachable magazine and has at least of the following:

1 An ammunition magazine that attaches to the pistol outside of the pistol grip

2 A threaded barrel capable of accepting a barrel extender,flash hider, forward handgrip, or silencer

3 A shroud that is attached to,or partially or completely encircles the barrel and permits the shooter to hold the firearm with the non trigger hand without being burned

4 Manufactured weight of 50 ounces or more when the pistol is unloaded

5 A semi auto version of an automatic firearm

I called them myself and was told this gun is a no go for NJ

 

1 The gun weight is 3.5 lbs thats 56 ounces

2 Has an ammunition magazine that attaches that attaches to the pistol outside of the pistol grip

3 Its a semi auto that accepts a detachable magazine

There is some considerable debate on this. Dealers can get most kinds of weapons. Whether they are supposed to sell them or not is a different story. It would not be the first time a firearm was incorrectly sold by a FFL. Brick Armory won't sell them and provides a statue for their reasoning. I would exercise caution and not buy one. Who wants to be the test case for a court battle?

BA - just to clarify, your re-typing of the statute left out some information, see the quote below, directly from page 4 of this link http://www.state.nj.us/njsp/info/pdf/fi ... 13ch54.pdf

For the record, the charger seems to violate based on #1 and #4 above - but I'm sure I could drill 7 ounces out of the grip to get it down below 50 oz. :twisted:

So a threaded barrel would be OK? Are there threaded barrels not capable of accepting a barrel extender, flash suppressor,

forward handgrip, or silencer?

Hello all: This is NOT legal advice.

 

The part of the code Brick Armory quoted is modified by the following sentence:

 

"A semi-automatic firearm should be considered to be "substantially identical," that is, identical in all material respects, to a named assault weapon if it meets the below listed criteria"....

 

The thing is, there is no named assault weapon even close to a Ruger Charger. Therefore it could not be substantially similar to something not on the named assault weapon list.

 

It would be therefore be legal.

 

Although this is not dispositive, frankly speaking if some shops and people in NJ are buying Chargers in NJ on permits that get filed with the police dept., you would think someone would have been arrested by now for possession of a assault weapon if they were deemed illegal.
